1. Acceptance of Terms

By visiting malinafz.com, registering an account, or interacting with any game, feature, or service offered on the platform (collectively, the "Service"), you confirm that you have read, understood, and agreed to be bound by these Terms and Conditions (the "Terms"). If you do not agree with any part of these Terms, you must not access or use the Service. Your only remedy in the event of disagreement is to discontinue use of the platform and, where applicable, to close your account. These Terms constitute a legally enforceable agreement between you, the individual user, and MALINA FZ LLE, the company that owns and operates the Service.

These Terms should be read together with our Privacy Policy, our Cookie Policy, and our Disclaimer, each of which is incorporated into this agreement by reference. Where a specific feature of the Service is accompanied by additional rules, such as the rules of a seasonal event or a community challenge, those additional rules also form part of your agreement with us. In the event of a direct conflict between such additional rules and these Terms, these Terms will prevail unless the additional rules expressly state otherwise.

We may revise these Terms from time to time in order to reflect changes in the Service, changes in the law, or improvements to our internal processes. When we make a material change, we will update the "Last updated" date at the top of this page and, where the change significantly affects your rights, we will make reasonable efforts to notify you in advance through the email address associated with your account or through a prominent notice displayed on the platform. Your continued use of the Service after a revision takes effect constitutes your acceptance of the revised Terms. If you do not accept a revision, you must stop using the Service before the revision comes into force. We encourage you to review this page periodically so that you always understand the terms that apply to your play.

2. Eligibility

The Service is designed exclusively for adults. You may only create an account and use the platform if you are at least eighteen (18) years of age, or the age of majority in the province, territory, or country in which you reside, whichever is higher. Although MALINA FZ LLE operates a free social gaming platform and does not offer any form of real-money gambling, our games use themes and mechanics that are intended for a mature audience, and we apply an adults-only policy without exception. If we discover that a person under the required age has created an account, we will close that account immediately and delete the associated profile data in accordance with our Privacy Policy.

You are responsible for ensuring that your use of the Service is lawful in the place where you live. The platform is primarily directed at players located in Canada, and we make no representation that the Service is appropriate or available in other jurisdictions. If the laws of your jurisdiction restrict or prohibit access to social casino-style entertainment, you must not use the Service, and any use in breach of local law is entirely at your own risk. We reserve the right to restrict access to the Service, or to specific features of it, in any jurisdiction at our sole discretion and without prior notice.

By registering, you also confirm that you possess the legal capacity to enter into a binding contract, that you are not prevented from doing so by any court order, guardianship arrangement, or other legal restriction, and that you are acting on your own behalf and not on behalf of another person. We may, at any time and at our reasonable discretion, ask you to provide evidence of your age or identity, and we may suspend your account until satisfactory evidence has been received. Providing false information about your age, identity, or place of residence is a material breach of these Terms and may result in the permanent termination of your account.

3. Account Registration

In order to play our games and access member features, you must register a personal account. During registration you agree to provide information that is true, accurate, current, and complete, including a valid email address that you control. You further agree to keep this information up to date for as long as your account remains open. If we determine that any information you have provided is false, misleading, or outdated, we may suspend or terminate your account after giving you a reasonable opportunity to correct it, except in cases of deliberate deception, where termination may be immediate.

Each player may hold one (1) account only. Creating multiple accounts, whether to accumulate additional Boreal Berries, to circumvent a suspension, to manipulate leaderboards, or for any other purpose, is strictly prohibited. Where we detect duplicate accounts, we reserve the right to close some or all of them and to remove any virtual balances or progress accumulated across them. Accounts are personal and non-transferable: you may not sell, rent, gift, lend, or otherwise make your account available to any other person, and you may not use an account that belongs to someone else.

You are solely responsible for maintaining the confidentiality of your login credentials, including your password. We recommend choosing a strong, unique password that you do not use on any other website, and updating it periodically. You must notify us without delay at support@malinafz.com if you suspect that your credentials have been compromised or that someone has accessed your account without authorization. Until we receive such notice, all activity carried out through your account will be treated as activity carried out by you. We will never ask you to reveal your password by email, telephone, or chat, and you should treat any such request as fraudulent.

As part of registration we will send a verification message to the email address you provide. Certain features of the Service, including membership plans, remain unavailable until your email address has been verified. If your verification message does not arrive, please check your spam folder or contact our support team for assistance.

4. User Conduct

The Service is a shared entertainment space, and every player contributes to the atmosphere of the community. You agree to use the platform in a respectful, honest, and lawful manner at all times. Without limiting the generality of that obligation, you must not: harass, threaten, insult, or intimidate other players or members of our staff; post or transmit content that is defamatory, obscene, hateful, discriminatory, or otherwise objectionable; impersonate any person or entity, or misrepresent your affiliation with anyone; use the Service to advertise, solicit, or promote third-party products, services, or websites; or attempt to collect personal information about other players without their consent.

Fair play is fundamental to the experience we offer. You must not use cheats, exploits, automation software, bots, scripts, macros, hacks, mods, or any unauthorized third-party tools designed to modify or interfere with the Service or to gain an advantage that the games do not naturally provide. You must not exploit any bug, error, or unintended behaviour in the platform; if you discover such an issue, you agree to report it promptly to support@malinafz.com rather than take advantage of it. You must not attempt to probe, scan, or test the vulnerability of our systems, interfere with the proper functioning of the Service, place an unreasonable load on our infrastructure, or circumvent any technical measure we use to protect the platform.

You must not decompile, reverse engineer, disassemble, or otherwise attempt to derive the source code of any part of the Service, except to the limited extent that applicable law expressly permits such activity notwithstanding this restriction. You must not copy, reproduce, distribute, or create derivative works from the Service or its content without our prior written consent.

We monitor the platform for violations of these rules and we act on reports submitted by players. Depending on the severity and frequency of a violation, our responses range from a warning, to the removal of content, to temporary suspension, to permanent termination of the account, as described in Section 11. We reserve the right to determine, at our reasonable discretion, whether particular conduct violates these Terms.

5. Virtual Currency

All games on the platform use a single virtual currency called Boreal Berries. Boreal Berries exist only inside the Service. They are a fictional play balance that lets you spin, play, and progress through our games, and nothing more. They are not money, electronic money, a deposit, a financial instrument, a voucher, a cryptocurrency, or property of any kind. You cannot redeem Boreal Berries for cash, goods, services, or anything of real-world value, whether from us or from anyone else, and no feature of the Service will ever offer such redemption.

When you receive Boreal Berries, whether through your welcome balance, daily replenishments, seasonal events, or a membership plan, what you actually receive is a limited, personal, revocable, non-exclusive, non-transferable licence to use those fictional credits within the Service for entertainment purposes. You never acquire ownership of Boreal Berries or of any other virtual item, and your balance does not form part of your personal assets or estate. Boreal Berries may not be transferred between accounts, sold, traded, exchanged, gifted, pledged, or made the subject of any transaction outside the platform. Any attempt to buy or sell Boreal Berries or accounts on third-party marketplaces is a material breach of these Terms, and any balance involved in such an attempt may be cancelled without compensation.

We manage the in-game economy in order to keep the games balanced and enjoyable for everyone. Accordingly, we reserve the right, acting reasonably, to adjust, recalibrate, cap, reset, or remove Boreal Berries balances, accrual rates, and virtual items at any time, including where an adjustment is needed to correct a technical error, to respond to abuse, or to rebalance a game. Because Boreal Berries have no monetary value, no such adjustment gives rise to any claim for compensation. If your account is closed, whether by you or by us, any remaining Boreal Berries balance lapses automatically and permanently.

6. Membership Services

In addition to the free experience available to every registered player, we offer optional membership plans in four tiers: Bronze, Silver, Gold, and VIP. Each tier provides an enhanced entertainment package, which may include larger daily allocations of Boreal Berries, cosmetic personalization options, early access to new games, and priority support. The specific benefits of each tier are described on our Membership page and may evolve over time as we improve the Service. Membership is never required: every game on the platform can be enjoyed with a free account.

Membership plans are billed on a monthly cycle. Your first billing period begins on the day you subscribe, and each subsequent period renews automatically on the corresponding day of the following month until you cancel. The amount charged for each tier is the amount displayed on the Membership page and at checkout at the time you subscribe or renew. By subscribing, you authorize us and our payment processor to charge your chosen payment method at the start of each billing cycle. If a renewal payment fails, we may retry the charge over a short grace period; if payment cannot be collected, your membership benefits will be paused until payment succeeds or the plan is cancelled.

You may cancel your membership at any time through your account settings or by contacting support@malinafz.com. Cancellation takes effect at the end of the billing cycle that is in progress when you cancel: you keep your membership benefits until that cycle ends, and you will not be charged again afterwards. Because membership benefits are delivered continuously throughout each cycle, we do not provide refunds or credits for billing periods that have already started or been used, whether in full or in part, except where a refund is required by applicable consumer protection law or granted at our discretion in exceptional circumstances.

We may change the price of any membership tier or modify the benefits it includes. If we increase the price of a plan you are subscribed to, we will notify you by email at least thirty (30) days before the new price takes effect, and the change will apply only from your next billing cycle after that notice period. If you do not accept the new price, you may cancel before the change takes effect.

7. Intellectual Property

The Service and everything that composes it, including but not limited to the games, software, source code, artwork, illustrations, animations, video, audio, music, sound effects, text, storylines, characters, game titles, logos, trademarks, trade dress, the "Boreal Berries" name, the Nordic Berry visual theme, the design and layout of the website, and the compilation and arrangement of all of the foregoing, is owned by MALINA FZ LLE or by its licensors and is protected by copyright, trademark, and other intellectual property laws of the United Arab Emirates, Canada, and other countries. Nothing in these Terms transfers any ownership interest in the Service or its content to you.

Subject to your compliance with these Terms, MALINA FZ LLE grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Service for your own private, non-commercial entertainment. This licence is the only right you receive in relation to the Service. You may not, without our prior written permission: reproduce, distribute, publicly display, or publicly perform any part of the Service; modify, adapt, translate, or create derivative works based on the Service; remove, obscure, or alter any copyright notice, trademark, or other proprietary marking; use our name, logos, or branding in any way that suggests endorsement or affiliation; or use any automated means, including scrapers or crawlers, to extract content or data from the platform.

If you choose to send us suggestions, ideas, feedback, or other comments about the Service ("Feedback"), you do so voluntarily, and you grant MALINA FZ LLE a perpetual, worldwide, royalty-free, irrevocable licence to use, reproduce, modify, and incorporate that Feedback into the Service without any obligation of attribution or compensation. We appreciate every message our players send us, but we cannot promise that any particular suggestion will be implemented.

All rights not expressly granted to you in these Terms are reserved by MALINA FZ LLE and its licensors. Any use of the Service that exceeds the scope of the licence described above is a breach of these Terms and may also infringe intellectual property laws, exposing you to civil and, in some cases, criminal liability.

8. Privacy

Your privacy matters to us, and the way we collect, use, store, and protect your personal information is described in detail in our Privacy Policy, which forms an integral part of these Terms. By creating an account and using the Service, you acknowledge that you have read the Privacy Policy and that you understand how your personal information is handled. We encourage you to review it in full before registering, and to revisit it whenever it is updated, because it explains matters that these Terms do not repeat, including the categories of data we collect, the purposes for which we process it, the safeguards we apply, the period for which we retain it, and the parties with whom it may be shared.

In brief, we collect only the information we genuinely need to operate the platform: the details you give us when you register, such as your email address and display name; the information generated as you play, such as your game history and Boreal Berries balance; and technical data, such as device and browser characteristics, that helps us keep the Service secure and reliable. We do not sell your personal information, and we do not use it for purposes that are incompatible with those described in the Privacy Policy. Where cookies and similar technologies are used, our Cookie Policy explains what they do and how you can control them.

Depending on where you live, you may have legal rights in relation to your personal information, including rights of access, correction, deletion, and portability, and the right to withdraw consent where processing is based on consent. Players in Canada benefit from the protections of applicable federal and provincial privacy legislation, and nothing in these Terms limits those statutory rights. To exercise any privacy right, or to ask a question about how your data is handled, contact us at support@malinafz.com and we will respond within the timeframes required by applicable law. If our Privacy Policy changes in a way that materially affects you, we will notify you as described in that policy before the change takes effect.

9. Disclaimer

The Service is provided on an "as is" and "as available" basis, without warranties of any kind. To the maximum extent permitted by applicable law, MALINA FZ LLE disclaims all warranties, conditions, and representations, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free; that defects will be corrected; that the platform is free of viruses or other harmful components; or that the results of playing any game will meet your expectations. Any material you access through the Service is obtained at your own discretion and risk. Additional disclaimers that apply to the platform are set out on our Disclaimer page, which forms part of these Terms.

MALINA FZ LLE operates a social casino for entertainment purposes only. The Service does not offer gambling, betting, wagering, or lottery services of any kind. You cannot stake real money on any outcome, and no outcome in any of our games can produce a payout of money or of anything that can be converted into money. Our games are games of chance-style entertainment played entirely with fictional Boreal Berries, and success in them implies no skill or likelihood of success in any real-money gambling activity. The platform is not a training ground for gambling, and it should never be treated as one.

Some jurisdictions do not allow the exclusion of certain warranties or conditions, so some of the exclusions above may not apply to you. In particular, if you are a consumer in Canada, nothing in this section excludes or limits any warranty or legal guarantee that applicable consumer protection legislation does not permit to be excluded or limited. In such cases, the exclusions in this section apply only to the fullest extent permitted by the law of your province or territory.

10. Limitation of Liability

To the maximum extent permitted by applicable law, MALINA FZ LLE, its officers, directors, employees, agents, and licensors shall not be liable to you for any indirect, incidental, special, consequential, punitive, or exemplary damages of any kind arising out of or in connection with the Service or these Terms, including, without limitation, damages for loss of enjoyment, loss of data, loss of goodwill, loss of virtual items or Boreal Berries balances, business interruption, computer or device failure, or the cost of substitute entertainment services, even if we have been advised of the possibility of such damages and even if a limited remedy set out in these Terms is found to have failed of its essential purpose.

Because the core Service is free to play and Boreal Berries carry no monetary value, our total aggregate liability to you for all claims arising out of or relating to the Service or these Terms, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total amount you paid to MALINA FZ LLE for membership services during the twelve (12) months immediately preceding the event giving rise to the claim, or, if you have made no such payments, a nominal amount equivalent to the price of one month of the Bronze membership tier. This allocation of risk reflects the free entertainment nature of the platform and is an essential basis of the bargain between you and us.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, liability for fraud or fraudulent misrepresentation, or liability under mandatory consumer protection rules of the jurisdiction in which you reside. If you are a consumer in Canada, you retain all rights and remedies granted to you by applicable federal and provincial legislation, and this section applies only to the extent that such legislation permits. Any claim arising out of the Service must be brought within the shortest period allowed by the applicable law of your jurisdiction, and where the law permits the parties to agree on a limitation period, within two (2) years of the date on which the claim arose.

11. Suspension

We want every player to enjoy the platform in a safe and fair environment, and account measures are the principal tool we use to protect that environment. MALINA FZ LLE may suspend or restrict your account, temporarily or permanently, or terminate it altogether, where we have reasonable grounds to believe that: you have breached these Terms or any policy incorporated into them; you have engaged in cheating, botting, exploitation of bugs, or any other conduct described in Section 4; you have provided false registration information or are below the required age; you hold more than one account; your account has been compromised and suspension is necessary to protect you or other players; your conduct exposes us, our players, or third parties to legal liability or reputational harm; or suspension is required by applicable law or by a competent authority.

Wherever reasonably possible, we apply measures proportionately: minor or first-time violations will usually result in a warning or a short temporary suspension, while serious, repeated, or deliberate violations may result in permanent termination without prior warning. When we suspend or terminate an account, we will inform you by email of the measure taken and, unless legal or security constraints prevent it, the general reasons for it. If you believe a measure was applied in error, you may contact support@malinafz.com within thirty (30) days, and we will review the decision in good faith and inform you of the outcome.

Suspension or termination of your account has consequences for virtual items. During a temporary suspension, your Boreal Berries balance, progress, and virtual items are frozen and inaccessible. Upon permanent termination for breach of these Terms, all Boreal Berries, virtual items, membership benefits, and progress associated with the account are forfeited immediately and permanently, without any compensation, refund, or credit, since none of these items has monetary value. You may also close your account voluntarily at any time through your account settings or by contacting support; voluntary closure likewise extinguishes any remaining virtual balances. Sections of these Terms that by their nature should survive termination, including Sections 5, 7, 9, 10, and 12, will continue to apply after your account is closed.

12. Governing Law

These Terms, and any dispute or claim arising out of or in connection with them or with the Service, including non-contractual disputes and claims, are governed by and construed in accordance with the laws of the United Arab Emirates as applied in the Emirate of Fujairah, without regard to conflict-of-law principles that would result in the application of the laws of another jurisdiction. Subject to the consumer protections described below, the courts of the Emirate of Fujairah, United Arab Emirates, shall have jurisdiction to hear any dispute arising out of these Terms or the Service.

Nothing in this section deprives you of the protection of mandatory legal provisions of the country, province, or territory in which you habitually reside. If you use the Service as a consumer, you retain the benefit of all consumer protection rules of your home jurisdiction that cannot be derogated from by agreement, and you may be entitled to bring proceedings before the courts of your place of residence where applicable law grants you that right. In particular, players residing in Canada retain the full protection of applicable federal legislation and of the consumer protection statutes of their province or territory, and nothing in these Terms limits, excludes, or waives any right or remedy those laws grant that cannot lawfully be limited, excluded, or waived.

Before commencing any formal proceedings, you agree to first contact us at support@malinafz.com with a description of your concern and to give us thirty (30) days to attempt to resolve the matter informally. Most disagreements can be settled quickly through a direct conversation with our support team, and we take every complaint seriously. If a court of competent jurisdiction finds any provision of these Terms invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. You may not assign or transfer these Terms or your account; we may assign our rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets, provided your rights are not diminished.

We answer every message ourselves, in plain language, and we aim to respond to all enquiries within two (2) business days. When contacting us about your account, please write from the email address registered to that account so that we can verify your identity, and never include your password in any message. For privacy-related requests, please indicate clearly that your message concerns personal information so that it can be routed to the appropriate team and handled within the timeframes required by law.

Notices from us to you will be sent to the email address associated with your account or displayed within the Service, and are deemed received when sent or displayed. It is your responsibility to keep your registered email address current, because important information about these Terms, price changes, and account measures will be delivered there.
